Welsh Tenancy Update

As of the 1st December 2022, new laws on residential tenancies in Wales came into force which will impact landlords in obtaining possession of their properties.
Previously, England and Wales had largely the same requirements for both granting and terminating a tenancy. However, landlords of properties in Wales will have to follow new requirements on granting a tenancy, including moving from tenancy agreements to ‘occupation contracts’, together with following new procedures in order to obtain possession.
The introduction aims to offer further protections to tenants by incorporating standard terms into the occupation contract, together with providing extended notice periods of six months to contract holders for no fault evictions.
For existing tenancies entered into before the 1st December 2022, there are buffer periods which have been provided for converting tenancies and using the existing possession procedures. For example, an existing tenancy may provide just two months’ notice for a no fault eviction up to the 1st June 2023 where this becomes six months.
