Is it time to make a Will?

As we approach the end of another year, you may be considering a New Year’s Resolution, losing weight or taking up a sport perhaps. If you haven’t done so already, however, we would suggest you add ‘Making a Will’ to your list of resolutions this year.
Why write a Will?
The most important reason to make a Will is to ensure that your money, property and other possessions pass to the right people, after your death. If you die without making a will (dying intestate), the law decides who inherits your possessions. This may be very different to your wishes. The important people in your life may not inherit. Instead distant relatives could receive your assets.
Secondly, writing a will makes the whole process much easier and less complicated for your family and friends, after you die. You choose who will administer the estate to ensure your wishes are followed. This may speed up the whole process.
Common Misconceptions about Wills
One thing we frequently hear is “I don’t need a Will because I am married”. However your spouse or civil partner may not, necessarily, inherit all your estate, especially if you don’t have a Will. You should consult a solicitor with specialist knowledge, for advice.
Similarly, an estranged or former spouse may have a claim on part of your estate. If you are not married and die without a Will your partner will not inherit anything, unless you make a Will to protect your partner.
